Welcome to the home page of the Hungarian Section of the Group of European Judges for Mediation.
The Hungarian Section of GEMME was founded thanks to one of the founding members of GEMME, Ms Béatrice BRENNEUR. It was her who invited me to Paris to the board meeting of GEMME in October 2007. I attended the meeting as an observer but I also joined the organisation there. Later on, I found some other Hungarian judges who share the same views on the application of alternative dispute solving methods in legal procedures. Since 2007 nine judges and one judge secretary and a barrister have joined the Hungarian Section of GEMME so at the moment we have twelf members:

We, the founders of the Section are resolved to study the different methods of mediation, its legal basis in Europe as well as the European practice of it. We are convinced that this will help us to provide assistance to the parties involved in legal procedures in courts to have recourse to mediation. At the same time, this will give an opportunity to judges and lawyers to apply this alternative dispute solving method in their work.
Act LV of 2002 on mediation in civil and commercial procedures, which took effect on 17th March 2003, lays down the general rules of mediation, determines the different services of mediation and the conditions on which one might have recourse to mediation either before or instead of a civil or commercial legal procedure. This Act on out of court mediation, however, cannot be applied dirtectily and automatically in court prodedures.
The Criminal Code has already made it possible to use mediation succesfully in criminal procedures.
The Book on Family Law of the new Civil Code is to deal with mediation in the Section on Parental Responsiblity. According to these rules, the judge will be able to order the parents to submit themselves to mediation if s/he considers it necessary for the cooperation between the parents or the excercise of visiting rights. In order that mediation be part of court procedures, it is essential to change the rules of procedure, to reduce the costs of mediation or make it free in certain cases, to change the way people involved involved in legal procedure think and to improve the training of mediators.
In Hungary, with the support of the Ministry of Justice and Law-enforcment, with the consent of the National Council of Justice and with the participation of the National Association of Mediation, a Pilot Programme of Mediation is being organised between 1st March 2009 and 1st March 2010 in three courts: the Metropolitan Court in Budapest, the Metropolitan Court of Labour in Budapest and the Municipal Court of Szeged. The aim of the pilot programme and of our group is to facilitate the peaceful settling of legal disputes, primarily with the tools of mediation and to contribute to the development of dispute settling in civil, family and commercial cases, as well as to encourage legislation and jurisdiction to apply mediation in court procedures.
